Terms of Service

These Terms of Service ("Terms") govern your use of the Megamize website at megamize.co (the "Site") and any services, audits, or engagements provided by Aaron Ginn d/b/a Megamize ("we," "us," "our"). By using the Site or engaging with us as a client, you agree to these Terms.

1. Acceptable use

You agree not to:

• Use the Site to violate any law or regulation
• Attempt to access non-public areas of the Site (such as /dashboard) without authorization
• Reverse-engineer, scrape at high volume, or otherwise abuse the Site infrastructure
• Submit false information through any form, including the Growth Pulse audit form

2. Free Growth Pulse audit

The 48-hour Growth Pulse diagnostic delivered via the audit form is provided "as is" with no warranty. It is informational and is not a substitute for professional advice. You take any action based on the audit at your own risk.

3. Paid engagements

Paid services (GROW, SCALE, custom engagements) are governed by a separate Statement of Work or Master Services Agreement signed by both parties. In case of conflict, the signed agreement supersedes these Terms.

4. Intellectual property

• The Site, content, and Megamize methodology are owned by Megamize
• You may share, link, and quote our public materials with attribution
• You may not republish our content for commercial purposes without written permission

5. Cold outreach disclosures

We conduct cold business-to-business outreach to potential clients via email, phone, and SMS. Our outreach complies with:

• CAN-SPAM Act — every email includes our physical address, an unsubscribe option, and accurate sender identification
• TCPA — calls are made during reasonable business hours; we honor Do Not Call requests; SMS only after explicit opt-in or two-way consent (see SMS Policy)
• GDPR Article 6(1)(f) — for EU recipients, our outreach is based on legitimate interests, balanced against your interests, and you may opt out at any time
• CASL — for Canadian recipients, we apply the same opt-out and identification requirements

To stop all outreach: email aaron@megamize.co with subject "Suppress" and we will remove you from all channels within 24 hours.

6. Disclaimer of warranties

The Site and free materials are provided "AS IS" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of liability

To the maximum extent permitted by law, Megamize shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any free materials. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the prior 12 months (or $100, whichever is greater).

For paid engagements, liability terms are set out in the signed Statement of Work.

8. Indemnification

You agree to indemnify and hold harmless Megamize from any claims arising from your misuse of the Site, breach of these Terms, or violation of any law or third-party right.

9. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of laws principles. Any dispute shall be resolved in the state or federal courts located in Travis County, Texas.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be flagged at the top of this page. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
